Welcome to MightyBuzz, a mobile application provided by DevBiz, Inc. (“we,” “our,” “us,” or “Company”). These Terms of Service (“Terms”) govern your access and use of the MightyBuzz app (the “App”). By downloading, installing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you agree to be bound by these Terms, our Privacy Policy, and any additional terms or policies that may apply to specific sections or features of the App. If you do not agree to any of the terms, you should discontinue using the App immediately.

2. Eligibility

You must be at least 18 years old to use MightyBuzz. By using the App, you represent and warrant that you have the legal capacity and authority to enter into this agreement and comply with these Terms.

3. Account Registration

To access certain features of the App, you may be required to create an account and provide certain personal information. You agree to provide accurate and complete information and keep your account credentials secure. You are responsible for all activities that occur under your account. If you suspect any unauthorized access or breach of security, you must notify us immediately at contactus@mightybuzz.com.

4. Use of the App

You agree to use the App in compliance with all applicable laws and these Terms. You are solely responsible for all content you choose to view, interact with, or engage through the App. The App fetches and summarizes content from third-party services (such as X, YouTube, and Reddit) based on user preferences. You agree that you will not:

• Use the App for any unlawful purposes.
• Engage in any conduct that may disrupt or interfere with the App’s functionality.
• Upload, post, or share any inappropriate, offensive, or infringing content.
• Attempt to gain unauthorized access to any other user’s account or the App’s systems.

5. Intellectual Property

All content, materials, trademarks, and intellectual property associated with MightyBuzz and DevBiz, Inc. are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works from any part of the App without our explicit consent.

6. Third-Party Content

MightyBuzz fetches public content from third-party platforms, including but not limited to X, YouTube, and Reddit. We do not control or endorse any third-party content, and we are not responsible for the accuracy, completeness, or legality of such content. You understand that use of third-party services is subject to their respective terms and privacy policies.

7. Subscription and Payments

Certain features or services within the App may require a subscription. Subscription plans, pricing, and payment terms will be detailed within the App. By subscribing to such services, you agree to pay any applicable fees and abide by the payment terms outlined.

You may cancel your subscription at any time through the App or respective app store (Google Play, Apple App Store). Cancellation will apply to the following billing cycle, and no refunds will be issued for the current billing period unless required by law.

8. User-Generated Content

You may have the opportunity to submit content through the App (such as comments, reviews, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content within the App. You represent that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights or applicable laws.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, without notice, for any reason, including, but not limited to, your breach of these Terms. You may also terminate your account at any time by deleting the App and ceasing to use it. Upon termination, your license to use the App will immediately cease, but the provisions of these Terms that reasonably should survive will remain in effect.

10. Disclaimer of Warranties

MightyBuzz is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or reliability of any content provided through the App.

We do not warrant that the App will be error-free, uninterrupted, or secure, or that any defects will be corrected. Your use of the App is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, DevBiz, Inc., its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the App, including but not limited to loss of profits, data, or business opportunities.

In no event shall our total liability for any claims related to the use of the App exceed the amount paid by you (if any) for using the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless DevBiz, Inc. and its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the App, your breach of these Terms, or your violation of any third-party rights.

13. Modifications to the Terms

We reserve the right to modify these Terms at any time. Any changes will be posted within the App, and the "Last Updated" date will be revised. Continued use of the App after the changes become effective constitutes your acceptance of the new Terms. We recommend that you periodically review these Terms for updates.

14. Governing Law

These Terms are governed by the laws of the state of Florida, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within Florida for any legal action related to the App or these Terms.
